We believe it is incumbent on Employers to clearly identify risks associated with a Project and whether those risks are to be carried by the Employer or by the contractor. Many disputes occur because the risks are not clearly identified and apportioned to the Parties.
During Early Design Stages and Pre-Tender, ProFacto can provide:
1. Contract specialists and commercial managers to review contract documentation

to ensure that the risks are clearly identified and contractor is made fully aware of those it is required to allow for in the Contract Price

to ensure that there are no conflicts between the documents forming the contract including, articles of agreement, conditions of contract, scope of work, specifications, drawings, environmental management plans, quality requirements etc.

work schedule management and reporting requirements, progress capture and reporting, including the impact of change

During Construction, ProFacto can provide full commercial support to manage the project, including:

commercial managers to manage Change, both Employer-instructed and Contractor notified

Work Schedule/Planning support to keep the Work Schedule up to date and identify the impact of Change or proposed change

Calculation of costs and liquidated damages associated with delays
Profacto will provide support to defend claims from Contractors or to prepare claims against contractors.
